Typically you sign a "PUD rider" (Planned Unit Development) at closing, where you agree to abide by the covenants and restrictions of the community. That document does not specify who manages the HOA, as the restrictions and covenants are typically formed prior to any units being sold. An HOA can choose to change management companies, or take upon themselves to manage the HOA. That in no way changes the restrictions of the community.

I've been the President of two different HOAs for 3 of the past 6 years.
