I agree with Michelle. Any lender should be able to help you pull equity from your home, if you qualify for the loan. Also, they will determine the value of your home through an appraisal and probably only give your between 70% and 90% of the value. Good luck! - Yesterday, 09:17

You signed the banks addendum to the contracts acknowledging that the bank has accepted your offer. Just because you don't have their signatures on it yet doesn't mean a whole lot. It is typical with some banks to not get that addendum back signed until just before closing. Pull out the addendum and re-read it carefully, it addresses your EMD question in there pretty clearly. At least it does in most bank addendums. You don't indicate that you are changing your mind because of your home inspection or because you can't get financing so I think you will find that you are forfeiting the deposit. I think that you are saying that you signed all of the bank's addendums indicating your acceptance of their offer. I am sure it clearly stated in there what happens to your EMD - take a look at it again. With banks so sometimes don't see the signed addendums bank from them until just before closing so that is not unusual that you haven't seen them. Did the banks agent tell you that? I would re-read the addendum as I think your answer is in there. Don't we always warn our clients to be sure before signing their name? Ace - I don't know your particular circumstance so it is hard for me to advise you. So, what I would do is have a few Realtors over to view your home and ask them to provide you a CMA (Comparative Market Analysis). The agent will take into account the location of your home, the condition, the presentation and then look at homes that have sold recently that are similar to yours. The agent will also look at homes similar to yours that are actively listed. From this information the agent will arrive at a suggested listing price reflecting the current market. After you know what you can expect to sell your home for it should point you in the right direction and help you decide if now is the time for you to sell or not. Good luck! - Mon Jul 14 2008, 06:32

Joe- my experience with REO homes is that they price the home just under fair market value and continually reduce until sold. At the time that they are putting it on the market they really don't consider what is owed. What matters at that point is what it is currently worth in this market. They have had an appraisal and at least 2 agents do a Brokers Price Opinion before arriving at the listing price. So, my advice would be to have your buyers agent pull some comparables and see if you agree that this home is listed at fair market value or just below and make an offer based on that. M - actually statistically speaking you will make less selling your home yourself. This is because an agent has the ability to market your home extensively to a larger pool of buyers. Thus, you are not limiting yourself to the few buyers that may see your sign in the yard or your ad in the paper. This is also because an agent is a trained professional with skilled negotiating skills.
