How much negotiation advice should my realtor give me?

Matt,

If you have ANY doubt about the level of service, expertise and commitment you are getting...or not getting...from your Realtor, you should seriously consider finding someone else. This is not an area where you can afford not to have an agent that has NOTHING but your best interests in mind.

Being a first time home buyer puts you in a position where you need an enormous amount of education about the process. You should clearly understand every single step that is involved. This should begin with your agent working directly with your Lender to determine exactly what sort of mortgage progam will be best suited for you and how the mortgage program...in conjunction with the property that you select...will be constructed. For example, do you need a Seller contribution for your closing costs, do you need a Buyer assistance program for your down payment, etc. These things and many others will actually determine how the offer for a property should be written. Then it's time to negotiate. And this is where a smart Realtor can really shine for their clients.

After negotiation and contract acceptance, there are a whole range of issues that will need attention and if any of them are overlooked, the result can be very costly to the Buyer.

Bottom line is this...whoever you choose as your representative should have the same respect from you as your doctor, your lawyer or your dentist. If you do not have this level of respect, you have chosen the wrong Realtor to represent you in the most important financial transaction of your life.

Actually, zero move in is the best approach to buying a home especially if you are a first time buyer. With mortgage rates as low as they are, it does not make economic sense to put any money down on a house...unless absolutely required by the lender...because the effect on your monthly payment is minor. For example...with rates in the 6% range, each $1,000 of down payment will only reduce your monthly payment by about $7.00...that's it. It is better to keep you cash.

Again, some mortgage programs like FHA require a 2.25% net investment in the property. But a seller can contribute up to 6% of the sales price towards the Buyer closing costs...reducing the Buyers cash requirements.

There are buyer assistance programs that can provide for the down payment and this together with a Seller contribution...if structured correctly - and this is where an experienced Realtor is important...you can basically walk through the door with zero cash out of pocket.

The con is that you're actually using your equity position in the property to cover these costs and you would not be able to sell the property for a couple of years without being in the negative. But if you are planning on staying with the home for a while, I highly recommend this strategy. It is one that I work towards with all of my Buyer clients.

The term rebate is a little misleading. What is actually happening when an agent "rebates" to thier client is that they are sharing a portion of their commission. with them And whether it's a Listing Agent or a Buyers Agent, the same thing is true...the less money that is available to the agent, the lower the service levels will be.

Take for example a Listing Agent. The cost to list and market a house is an expense that the agent pays out of pocket. The less money that is available to them when the house sells translates direclty to the less money they can spend up front to get it sold. And in this market, it takes A LOT of marketing to compete. And the longer the house sits on the market because of a lack of marketing, the more out of pocket expense it costs the seller. So the "rebate" gets eaten up in the long run.

Same things with Buyers Agents. It costs them money to represent a Buyer...gas, dues, office supplies for reports, etc. And if a Buyers Agent has to give their client part of their commission, they will probably look for those houses that have agent bonuses etc. so that they can make up the loss. This may mean that the Buyer is not seeing all of the properties that might meet their critiera.

Not knowing the intent of you wanting a rebate, there may be other ways to accomplish this without resorting to working with a rebate agent. I highly discourage this because truly..."you get what you pay for". And when you are dealing with this kind of financial issue, you want the best.

The attitudes that I read in some of these posts...no harm - no foul, let sleeping dogs lie, pick and choose your battles in life, etc...are exactly why things like this happen to Buyers and Sellers in the first place. Who gave the keys to who and when really doesn't matter...there is no clear cut procedure for this anyway. But what does matter is that you as the Seller were put into an extremely dangerous situation.

Until the Buyers loan is funded, you as the Seller have complete and 100% responsibility for the property. That is one reason you don't cancel your homeowners insurance until after the actual funding date. If the Buyer had caused accidental damage to the property...like a fire...or had fallen off of a ladder and injured themselves or the keys had gotten into someone elses hands and the property was vandalized...any number of things...you as the Seller would have been responsible. I am sure you know all of this already. And fortunately you were luck and none of this happened.

But here's the thing...

If you do not do anything about what happened, this sort of unprofessional behavior will continue and the next time it happens, the Seller may not be so lucky. Our business is one of professional standards. And to take such a casual attitude towards it as I have read in these posts is one reason we as real estate agents are not respected as we should be.

The Texas Real Estate Commission has a procedure for filing complains against the real estate community for issues just like this. The procedure was put in place for a reason...so that we can stop these kinds of things from happening again. And sometimes, TREC may even create a standard to cover this sort of situation if they feel it is important enough. But if they don't hear about it...not much they can do.

Our Code of Ethics states that it is our responsibility as agents to our clients to protect and provide for their best interests. My opinion...I don't see that this was done in your case. And I believe the real issue is...were you represented properly by your agent.? If you don't at least file a complaint, you are doing the real estate industry a disservice. To me, this was not a minor issue...it could have turned out quite badly

As you can see, I feel very strongly about these kinds of issues. And only you and the many other Buyers and Sellers that these types of things happen to can help us in clean up this industry. Too many agents take a much too casual approach on how they do business and in the end it usually affects their clients.

Again, this is my opinion but you are in a position here to make a difference.
