Courtney, I don't believe I-agent is operating in Texas at this time. From what I saw on the website I would doubt that many people would want the hassle of dealing with them. - Earlier today

Lindsay,IMHO you don't want to give a preapproval with the amount added in to the sellers agent. I always block out the amount or ask for a letter just stating that you are preapproved (though some lenders won't do that without an amount). Whether it is for the amount of, or more than the list price it gives the other agentds something to come back with. This is information they don't need to know. - Earlier today

Janice, What a shame! This isn't the way it should work at all. I always tell my clients that if they are unhappy, then I'm unhappy and they can "fire" me at any time if they don't like my marketing or feedback. I would go to the broker and tell them that you WILL tell everyone what bad service you are getting unless you are let out of the contract. This is a horrible situation and shows why hiring the right agent is so very important. - Tue May 13 2008, 14:34

Are you counting on 3rd Party Financing? As long as the addendum is in there then you have to come to agreement if the house doesn't appraise, because the bank won't lend you the ehtire amount. Work with a good agent that can guide you and you should be alright. In general the homes in Texas are not going to go down further. We never had the extreme increase that some markets had and growth is VERY good.

Breach of Contract?

Dear Buyer,
You probably have grounds to sue for specific performance, however you won't get anywhere if they can't buy the house. You should be able to keep their earnest money at a minimum since your house was off the market for a time. What does your agent say? I'm relatively sure that your agent would have requested a preapproval for them and now the lender should be called to ensure that this isn't the case. At the very least they should be submitting a letter from the lender stating that they no longer qualify for the loan. - Sun May 11 2008, 09:36
