Several questions need to answered on your claims: Who was responsible for disclosure? In many cases a loved one must disclose what they know about a property that they may have never lived in. If the owner is deceased or in a nursing home, one can only disclose what they know to be fact. Foreclosures are a nightmare, you get zero disclosure. Buyers are on defense with home inspections and title searches to avoid BIG mistakes as it appears you have done in this case.
What do you mean by DEP issues? Did the person responsible for disclosure have any way of knowing this might exist?
Title issues happen every day. They show up when you least expect them, even under normal circumstances. What kind of title issue, can it be corrected?
