Why did you not ask your realtor about this BEFORE you wrote the offer? It seems to me it is only prudent to make sure you know what you are buying before you pull the trigger. What does the prelim indicate?
The bank is NOT necessarily responsible. It could all be in the purchase offer. Under "normal" circumstances, yes the "seller" will have to provide for a free and clear property inorder to change title. But......in REO's and in short sales, be carefull, becuase often there are no normal situations out there. Most banks have their own "purchasse offer form". Read it carefully as it usually contains a lot of "demands", from the buyer. Are you paying all cash?
