In the state of Ohio, it is not necessary to provide a property disclosure form in several situations. If you were represented by a Realtor, then you need to contact that agent to see why you never received a property disclosure. Maybe the home was owned by the bank, maybe the home was not occupied by the owner in the past ......months or maybe the home was being sold by the owner and not through a Real Estate Broker. All exclusive right to sell contracts that a broker holds in the State of Ohio must have a Residential Disclosure form completed by the owner as long as they occupy the home. It must be on file and readily available. That is the law! I am assuming that you did not have representation and that is very sad since in the state of Ohio, you pay NOTHING to be represented. The seller pays the fee. That is why sellers cringe when they see a buyer who is represented. It is the real estate agents job to make sure that they protect their customers and work in their best interest. That is our code of conduct...it is our ethical standards. That way you will be able to determine why you did not receive this form and it will help you avoid problems when you decide to buy or sell in the future.
