Well this has become an interesting discussion! I have determined that it is definitely legal for the buyer's agent's husband to inspect (and reinspect) the WDO.
I agree with Walter, though. It doesn't mean that they SHOULD be doing this. If you have to defend yourself by saying something is "perfectly legal", then clearly you are making others uncomfortable and doing something that is ethically questionable.
This has turned in to a drama. My listing is in great shape and it has been covered by a termite bond and yearly treatment for the entire time my sellers have owned the home. The man who did the WDO inspection has been overzealous to say the least. I am advising my sellers to pay 1% only and if the buyers want this work done, they will have it done themselves and pay the difference. I am not going to put my sellers in a position where they choose someone to do the work and have the buyer's agent's husband come back to reinspect it! I am certian he will say it is not completed and he will not pass it. I resent this and I will absolutely not work with this husband and wife team in the future. - Fri Sep 4 2009, 10:34
