Foreclosure is taking back title of the property because a promise to pay a note defaulted. This process occurs in a different court and a much different process. A real estate attorney "or trustee" would be best used for this.After foreclosure occurs, you hope the property is then vacant so you can take possession. If not, the next step is eviction to get the occupants out. I would suggest that you speak with a Real Estate professional in the area to help. Their services usually do not cost you anything as a buyer (which is why 9 out of 10 are working with a professional) and they will know the areas, whats available, assist you though the process from a list of good area lenders, negotiating the best price for you, explaining the importance of inspections, etc. and should make this a pleasant experience. As far as rate of return, Texas has had a very steady growth of 3-5% per year in property value unlike some of the country that spiked and peaked quickly in recent years. Alot of investors are looking here to acquire more real estate for the dollar. When you acquire property in the center of a city like Austin, Texas (the capital), values are higher and increasing more rapidly in the center or near downtown areas. Just like Houston, Dallas or San Antonio. The addendum is a written promise to the contract regardless of whether it is buyer/seller or from the Real Estate professional stating that she is promising to pay the 0.5% from her fee towards your closing costs. All agreements or promises should be in writing and it is very common to have an addendum or Exhibit attachment for additional changes to a contract. A real estate professional may gift back professional fees towards the principals costs (buyer or seller), providing it is on the HUD-1 @ closing required by law. The signed addendum is a document that the Title Co or Attorney will use to facilitate this agreed approval of funds use.
