I did state I already had a buyers agent.
I took the time to explain why I did not want to use him but if I needed one I had him.
My thought was the selling agent would get the full commission in hopes she would be willing to make my offer more appealing.
I decided not to go further with the offer because I don't play games.

I was speaking with a well respected realestate attorney about your sisituation. He indicated you are not a lone many others in our area are in the same boat. As the market sinks he is finding more and more desperate realestate agents sinking thier morals and bending the rules. His advice contact an attorney(surprised?) and don't listen to others hearsay about laws. He finds more often than not there is a good case in matters such as yours but most people just don't follow through with what should be done.

I too have had dealings with less than ethical agents in the recent past. You may wish to contact your county codes and assessors offices. I found out tons of information about past inquiries, inspections and even sellers agent requesting that past violations not be given out to perspective buyers. I agree with the previous posters contact an attorney. I wouldn’t bother contacting the selling agent or company if this person is operating in this manor. It is probably accepted by his agency and even encouraged. - Sun Jun 29 2008, 02:57

I like the answer you received from Pauline Charlton. I like the ideal of three opinions. I would ask for comparables both still on the market within 1 mile and sold with in the past 45 days. I wouldn’t accept anything past 45 days due to the quickly changing market. You probably know more than most realtors about your general area but are lacking in sources of information. Once you are armed with knowledge of what has sold and how much, what hasn’t for how long. You will be much closer to an accurate and fair value. Most agents are more than willing to assist you.

I have looked at many short sales and foreclosures in the Riss Lake, Nationals and tons in the Thousand Oaks subdivisions. I agree with the others here the term is usually used in the manor here as to referring “accepting backup offers”. Are you buying with a contingency on selling you’re old home? Most selling agents will seek back-up offers. The agent is just doing his job in representing his client “the seller”. I wouldn’t sweat it most agents won’t bust a contract in fear of a law suite.

I know you have your heart set on this house and I hope all goes well. But, if you don’t there are many vary nice homes in the 64152 area and the prices are falling fast. If you are looking for anything over $250k it’s a great time to be buying not much is selling in this price range. - Sun Jun 29 2008, 02:29
