In general, mortgage companies start foreclosure processes about 3-6 months after the first missed mortgage payment. Late fees are charged after 10-15 days, however most mortgage companies recognize that homeowners may be facing short-term financial hardships. It is extremely important you stay in contact with your lender within the first month after missing a payment. That being said, there is nothing in your loan that would allow your mortgage company to refuse to accept your monthly payments, as long as you are paying the set amount every month and any incur penalties for being late or missed payments. If your mortgage company have started the foreclosure process they will NOT accept your monthly payments. If that is the case then you should seek legal advise. - Thu Dec 18 2008, 15:20

Hmmm, Let me get this right. Your house went to auction, you vacated the house before the auction and the auction winner is suing you for rent. Well, if you don't you have a lease, which I don't think you do since it was your house before auction I would seek legal help . Don't sign any paperwork just go and seek legal help is the best thing to do in your case. - Thu Oct 30 2008, 12:38
