rest assured, I was joking about the natural disaster.
I have pleaded with the loss mitigation debt who are(were) handling the short sale, I have gone in person to several branch offices, I am on the hook no matter what unless the home sells. I have provided my decree to more people than I care to mention. have been in court 8 times regarding this, have judgments on judgements, doesnt do any good. I will not allow this into foreclosure as it's the easy way out for my X, why should I face the destruction of foreclosure for a property given to her 3 yrs ago? I will continue what I'm doing & have a judgment allowing me to do so & that's to keep deducting 2k per month from the maintenance I give her & pay that 1st mortgage. the equity line is in default, cant do anything with that unless the lender decides to push it..
I mean no disrespect, I have pleaded with half of creation, given the decree, filed paperwork for hours upon hours with credit agencies, lenders, realtors, spent countless hours down at hennepin county self help center, had 4 attorneys, been in front of 3 different judges... I am not on title, was removed at the time of the divorce finalization. I have no say in anything regarding that home as it was awarded to my X.
I have had 4 attorneys involved in my divorce, in court 8 times, & here I am being destroyed..
There is no prevention to what's happening, the home must sell, THE only option, short of me agreeing to a foreclosure & that I wont do as I'm associated with a family business. Courts can not force my name off the notes due, tried that more than once.. Get this- my X is court ordered to keep the home in presentable selling condition, but, she abandoned the home 4 months ago, the home sits empty, absolutely no maintenance whatsoever is being done, basement ceiling is now covered in black mold, absolutely cant be sold in this condition & all the while this equity line is in default, has been for 8 months to this point, destroying my credit & financial abilty for anything. Now I'm forced back to court to take action against her, 9th court date and all for what? what will they do to her, spank her? she is diagnosed borderline schizo, diagnosed bi-polar, diagnosed chronic depression, she couldnt care less... Took the listing agent 3 full weeks to Fax the signed PA to the lender. Listing agent has power of attorney for my X. Listing agent sat on the short sale acceptance for a month before telling the buyer in hopes of a higher offer coming in, which in turn lead that buyer to walk away, now the home sits again.. My situation is an extreme one, involves 50k in attorney fees, 8 court dates, 5 yrs & still ongoing with no end anywhere in sight. There are so many things involved, being destroyed by an equity line against this home, equity line has been in default for 8 months, my X was awarded the home & all encumbrances over 3 yrs ago but failed to assume/refi or sell to remove my name.
