Thank you all for your answers. I was hoping that someone had experience with this type of issue. This is not a short sale and the seller insists that their intent was not to sell the home for the price on the paperwork. They have agreed that this was their mistake, but are unwilling to negotiate and insist that they will not sell us the home. The difference is price is $40,000. All of the paperwork is signed including the legal description. The seller missed putting their initials on form 22J, but they did sign the document (twice - once on the first page and on the second page where we were suppose to sign) The "mistake" was made by the seller and their agent did not catch it. Our agent did not discuss price with their agent, so she was not a fault. She has never had this happen and is trying to reach her broker to determine the next steps. We signed and returned all of the counter paperwork on Friday. It was our understanding that we had a mutually accepted offer at that time. On Saturday, the selling agent called to say that they had made a mistake on the price that was accepted. We want the house, but at the mutually agreed upon price. - Sun Apr 6 2008, 12:30
