No, not in Woodbridge.

Approx 25 years old. The adjoining home also had a crack in the foundation/slate under the dining room carpet that was repaired w/cement.

HOA only covers roof and siding.

Agent says its up to me. I can walk if they don't want to prove its not damaged. They say its been in only a few cases where someone like me (lol) has been this determined to make sure that the termites didn't do anything while they were hanging around.

OK, there was no damage whatsoever found in the attic, around doors or windows. We have asked for the seller to retreat and to cut open the sheetrock in a hidden area where tubes were found. Opinions to us have ranged 90-10 in favor of not insisting on the cut in because, as Deborah said, all have had or will have WDI at one point in NJ. This is a townhome and the adjoining neighbor has never had evidence of termites in his place... - Sun Nov 25 2007, 17:37

With obvious infestation of WDI at some time (this was not on the disclosure) my question is - what can you do. I would like not only the obligatory proof that termites are gone - but how do you know what damage if any was done 'under there'?? - Sun Nov 25 2007, 13:49

Wouldn't she be hard pressed to deny knowledge of a termite 'visit' when there are visible tubes, visible wiped away tubes and visual evidence of treatment - ie the holes were cut in? - Sun Nov 25 2007, 11:33

Even if the report was submitted to her Agent AND attorney? The report included detailed pictures of the cracks, termite entry, etc. The seller replied with 'what do you require do have done in order to make the deal work'? No, I have an attorney. It's just easier to get generic info first and then discuss with my ESQ. I already have the 3% closing fees to be paid by seller in the agreement but we just had our inspection and I am trying to get a feel for what creative ways repairs can be addressed outside of lowering the final selling price. - Tue Nov 20 2007, 08:10
Great. So this is a clause that is accepted? ie, mortgage companies can cap what you can receive as a seller concession on closing costs at 3 or 6% - that's why I was curious as to whether they have any say on the particular point of down payment help. - Tue Nov 20 2007, 07:43
