The sellers gave the possession of the house from May 30th and we moved in before closing. The closing was done on June 10th, by God's grace. It was tough emotionally, knowing when we can move, when we could close. But all went well fine at the end, with a delay. Thanks for all who responded and gave your opinions in Trulia. - Wed Jun 11 2008, 18:31
Larry,
The form you mentioned is used for buyer possession up to 7 days ONLY. The lifting of the court order (lender binding on the seller) may take 5 more days. How would I extend the possession beyond 7 days. Is there a another form to support this clause?
Thanks for your reply. - Mon May 19 2008, 18:10
yes, I do have a my real-estate attorney and she says the sellers must have disclosed it when signing the contract. She also says I can sue the sellers for compensation. I understand that I have the legal option.
There are no liquidated damages clause in the NC Purchase Contract. - Mon May 19 2008, 16:19
Thanks Larry, We have completed inspection and have negotiated the repairs. Closing was to be done in 2 days. We have our own closing attorney and the seller has her attorney helping her. We are thinking of moving in without having any rent payment until closing. This house price is a good deal for us and also we have already spent up to $1200 (inspection, loan, attorney, tittle etc) and lot of time. If we walkout at this point how much can we be compensated? Will we be compensated for the time we spent? - Wed May 14 2008, 10:47
Hi Rusty.
Thanks for your reply.
The seller agent did not disclose any details of the personal issue. He just mentioned that the closing may be delayed due to one of the seller's personal problem. We already know through other source that the sellers are divorced.
We are looking for expert suggestions on what to expect in cases like these. - Mon May 12 2008, 17:26
The sellers are divorced and taken different paths. Can the sellers new life partner make any legal issues/claims in this property, which is on the sellers names. - Mon May 12 2008, 16:46
