The property at 8150 E Broadway is listed as a condo unit but you may have seen it incorrectly categorized as a townhome. It is actually a co-op (link provided below) and the monthly fees are $195. Those fees cover roof, building maintenance, pool, water, gas, taxes, and grounds upkeep.&#13;

Sun City Vistoso is a larger Del Webb subdivision and  Vistoso Village is a more private gated community. &#13;
&#13;
Heritage Highlands is also about 10 minutes to the west in Dove Mountain.&#13;

Sound like you're in a tough spot, and hopefully you'll receive some helpful information here. &#13;
&#13;
It is unfortunate that your lender isn't willing to entertain a loan modification or forbearance of some kind. If you don't pay your mortgage (first or the second), the lender will have the right to being foreclosure proceedings.&#13;
&#13;

You also have a few other options on the table:&#13;
1) Refinance through a traditional or hard money lender and obtain a foreclosure bailout loan, if there is enough equity to qualify.&#13;
2) For FHA loans, obtain a partial claim to get current. This will result in a lien being placed on the property for the amount of arrears, but reinstates the mortgage.&#13;
3) Sell to a private investor or friend/family member who will allow the homeowners to continue living in the property.&#13;
4) File bankruptcy and include the house (Chapter 13), and keep up with the court-ordered repayment plan.&#13;
5) Sell the property for less than what is owed through a short sale. Tax liabilities may be a result of this option. &#13;
6) Offer the bank the deed to the house to avoid going through with the entire process with a deed in lieu of foreclosure.&#13;
7) Just move out, abandon the house, and begin the process of becoming financially stable after foreclosure.&#13;
&#13;
Keep in mind that most of the above options have significant credit and tax repercussions. I recommend speaking with a tax professional for further clarification.&#13;

Looks like your question was cut off but it sounds like you are asking if you could buy the subject property with a discharged bankruptcy.&#13;
&#13;
You're probably better off consulting with a tax or bankruptcy professional. Lenders may be unwilling to fund a loan for someone in your case but to be sure try to get pre-approved for a loan and see what happens. The last recorded sale in the MLS system was in 1992, and taking a look at the Pima County Assessor's website doesn't yield any other information. I'd first off like to say your is an unfortunate but increasingly common situation. Luckily you have a rental property to fall back on.&#13;

That being said, you have many options, and you should probably speak with a tax professional regarding the repercussions and ramifications of each in relation to your liability. &#13;

A foreclosure is a last resort and most banks would like to avoid that if possible. At that stage they will be forced to spend money to process/secure/maintain/sell the property (an average of $50k). An alternative to foreclosure is a short sale.  A short sale (where you sell the home for less than what you owe, hence the "short") may be a possibility, but be aware that your credit will still be severely impacted but not to the extent of a foreclosure.&#13;

The Hope for Homeowners act (H4H) was actually signed into law last summer but most lenders have NOT jumped on board due to the governments inaction in regards to actually funding these modified loans. You should speak with an accountant or tax professional either way. If you walked away from one property (or both), there would be tax issues that only a qualified professional should advise you on, and they would depend on a myriad of factors (type of loan, if it was refinanced, type of refinance, your current financial situation, etc.).&#13;

That being said, if you do end up doing a short sale be sure the agent you use is qualified and has handled short sales before. It is easy to get lost in the maze of legal and financial departments at a bank and if there is anything you do not want to waste when you are facing foreclosure it is time.&#13;
