Did the Seller and their agent Counter your offer verbally or by email and fail to then write the countered price in the offer back? If there is no change in the price on the final contract that is sent to the settlement attorney it will be assumed the price in the contract is the right price. This may make for an angry Seller, and the Listing Agent will be the one they turn to. Has the contract been officially ratified? if so you may be buying the house at your original offer. I'm still unclear however who did the countering and who the last one to sign off on the contract was.

Any changes on a contract must be initialed by all involved parties to indicate agreement. Otherwise, the change is not honored.

Connie,

From what I gather from your question... you made an offer (I'm guessing not full price) on their property which they then signed all the changes except for price and sent it back?

If this is the case your agent should have realized the mistake and contacted the selling agent to have her clients initial any changes that were made. This saves and potential issues later within all parties. Such as from seller to their agent (you didn't properly discuss this offer with us), or between yourself and the sellers.

If this doesn't answer your questions please post another thread to this question(answer this question) so I can better assist you.
