can real estate be divided that is held in dispute over a trumped up will awaiting to be determined in court?

wife of 25 years dies, just before death while under legal and illegal drugs, she disinherits minor son and husband and gives her portion of estate to son and ex husband from previous marriage .
Oxycontin, steroids, illegal marijuana as well as cancer thuout her entire body are involved
Eldest son and ex husband have re recorded with tax assessor that they now own our home and , other real estate, as well as my business and have laid claim to our irrevolkable life insurance policy.
The whole mess is awaiting probate hearing ( months away ) and I desire to split realestate to get somewhat whole again for the time being .

Bruce,
I think you need to wait for your day in court. It's frustrating but I don't see anyway to move forward without clear title. Realtors can't give legal advice I hope you have a good attorney.

Chances are you will not bea allowed to do anything with the home until after the hearing. Have you tried having a conversation with the ex? I know it's a difficult situation, but he might be just as interested as you are to make this go away.
