Can HOAs regulate smoking in my home?

Roger is correct. California is leading the nation in rules about where smoking is permitted. Many condominium complexes have units that share outdoor living areas. It can be a real battle between smokers and non-smokers when the smoke drifts from one space to another.

Courts have been upholding HOA rules against smoking even in private units all over the country. There's a movement to ban smoking in community-owned spaces like condo complexes, even inside, and the typical legal angle is to treat smoking as a nuisance, much like other kinds of air pollution. Some cities are even passing ordinances giving HOAs the right to regulate smoking.
