Patti, Both Buyer and Seller in Illinois

Is there legal action that can be taken after a closing in Illinois if you can't get information from seller?

Before we closed on our house we asked the seller to make repairs on the basement drain which we noticed backing up with water during the home inspection. He agreed to it and supposedly had it fixed. We have closed and been moved in for two weeks. During this last week we noticed water in the basement. We called our realtor to find out who made the repairs on the drain. She informed us the selling realtor would get hold of the seller and will let us know. It has been a week. Is there legal action we can take? We live in Illinois.

I hope you got a copy of the repair bill when you closed. As Bill stated I would strongly recommend you contact your real estate attorney that closed the sale. Best of luck!

Did you "ask the seller" via a condition in the contract? The parole evidence rule assumes the written contract to be the complete compilation of terms for your agreement.

As an agent in these situations, we insist on a reciept issued by the repair company, so that when situations like this occur there is documentation of the repair being made and who to contact is there is a failure involved with the repair.
