Jim, Home Buyer in

I wanted to get into the house after the contract is over, but owner would not let me in. What can I do?

I have recently purchased a house and before the closing would like to get into the house for making hardwood floor measurements which I want to install after the closing. Owner would not let me in and making excuses and when I tried to work with realtor, he said that he can not do anything about it. I checked in the contract and could not find any clause regarding this. Any advice how can I handle this situation?

I would be very concerned about this . Are you working with a Realtor? If you are not ,you should be ! In my opinion the seller may have somthing to hide and it is in your best interest to possible postpone your closing to make sure that somthing has not gone wrong. What State are you in? I wish you all the luck and consult with a Real Estate Pro your area!!

You definitely should have a walk though before closing.. As for measuring.... usually with my listings (and other listings I have sold) we discourage buyers from measuring, looking at paint chips, etc. This is still someone's home, that they love. It isn't polite to redecorate their home in front of them.

In your contract there should be a claus efor a final walkthrough the day before or jsut before closing, at this time you could do your measuring. Unfortanately the seller does not have to let you in the house prior to closing. It is extremely rare however for this to happen. Was there something that has made them act this way. If you give them notice and ask when it is convenient for them, they should nt say no but unfortanately can. Just make sure you do your final walthrough so they are not hiding anything like a flood, damage or they removed everything. Goo dluck with your situation Jim, try and have the agent work on them a little.

Hello Jim. Not knowing where you are located makes it difficult to give you advice as we don't know what the customs and standards in your particular market are. We also don't know whether you have already removed your inspection contingencies. In CA, the buyer is entitled to access the home to conduct inspections and of course the inspections have to be conducted at reasonable times and with sufficient notice. Once you have removed your inspection contingencies, you usually will only access the house again for the final walkthrough. Since you don't mention what the seller's excuses are, it's hard to evaluate whether his reasons are valid. I am afraid that we can't be of more help without more detailed information.

Sometimes, after the contract has been negotiated, the sellers get a little... well... " hinky ". They've just spent the last 3 months, primping and cleaning and having their house available for viewers at all hours.

Perhaps, as part of your purchase, you came and viewed the home 3 or 4 times. Some sellers don't mind you coming afterward, to show your daughter, who was away at college, or show to your mother-in-law who hasn't yet disapproved of the house. But some sellers don't want to allow any more showings, and unless you've written "seller will allow reasonable access to the home between now and closing"... they have zero obligation to allow you back into, what is still, their house.

Frustrating? Yes, a little... but unless you've had the foresight to request "visitation", your agent is correct.. there's nothing he can do, short of begging and pleading.

You will, of course, be allowed your walk-through, but that's typically only a day or two before closing, and that might be a bit late for you.
