help me write a letter for not closing on a pre-construction.

ok, so at this point I think my wife and I have accepted that we won't get our deposit back, how can we write a letter telling the developer that we will not close, that if we could get our deposit back it would be great, but reassure them that we are not closing, help please!!

We agree this is a legal issue that would best be referred to an attorney. Let them make the determine if you should give up your deposite money.

I agree with Myke and Angela. One area I would pay attention to is whether the home was completed within the two year period. I believe, confirm this with an attorney, that a builder has 2 years to complete a home from contract to close. If the builder does not complete the home within that time period, I believe (again, confirm with an attorney) you stand a very good chance at receiving a return of your deposit.

You really need to ask this question of a real estate attorney. A real estate agent doing this for you would be practicing law without a license, and could lose their license to practice real estate.

Javier: I think you should get some legal help with this as there may be a possibility of your getting your deposit back or possibly part of it. I don't know. There is an attorney who specializes in condo and pre-construction law. His website is http://www.depositrecoveryservices.com I'm not recommending him but I came across this website and thought this was a great match for your situation. It's worth a free consultation at least. They're based in Fort Lauderdale.
