Should there be limits on the governments use of eminent domain, or is it always justified because the government must pay fair value?

I agree with David. The system is broken. It is just wrong to take someones home just because its desirable land and some developer can make a boat load of money by building condos. There has to be a way to make this insanity stop!

There are not enough limits, my city tried to take a womens home because they wanted more park space. Fair market is not paid to most of the people unless they have enough money to fight it. Now they want to take peoples homes in my community to make affordable housing. Yes we should have affordable housing but not at the expense of a happy homeowner. They also want to take peoples homes and then sell them to a developer so we can have huge condos and increase the tax base. Don't get me started!

Typically Eminant Domain is used to redevelop land. Normally it is allowed if the new use is for the "Highest and Best Use of the land". So they may tear down your house to build a hospital or freeway, because those entities will serve more people and bring in more tax dollars than a single family dwelling. The government pays what they want and I would not say it is always fair. I know of a case in TX, where a farmer lost about 50 acres for the state to build a freeway and he waited three years after it was built to get paid. Personally I feel there should be more limits on ED.

Oh boy, should there be. It's not always justified. Fair value is subjective. I hope you'll do some research to come to the conclusion that makes sense for you since we'll be voting on this very topic on June 3rd.
