Has your current agent been really trying to sell your home for you but having a tough time in a difficult market? If so, he/she is likely as frustrated as you are. IF you feel that you would like to compensate your current agent in any way, talk to him/her and ask to be referred to another agent/agency who is successful in your area. Your current agent can do the research, make the arrangements for you, and he/she can be compensated by the new agent with a referral fee when the property sells. It is a win/win.
If you are unhappy with your current agent because you don't feel that he/she tried to do a good job, then here is how to proceed: Call the two most successful companies in your area and ask to speak with the broker. While you have a contract with an agent another agent cannot go to you for the business. But, you can seek out an agent if you like. As long as you make the first step then there are no ethics problems. I am sorry to hear that it has not worked out with the agency you are with. You can always approach the broker in charge of the agency if you have a problem with the agent. Do you have any specific problems with the agent? How many showings has your home had in the 9 months? Have you had any open house events or agent tours? How is your home being marketed? Without knowing the background on the situation I would hesitate to make any statement in reference to your present agent.
