Is the requirement in adult restricted age communities always a minimum age of 55?

No. The communities usually have a 80/20 ratio because it would be discriminating to not all housing that is on the open market. However, there are ways to have the homes less appealing to families with children. Covenants typically disallow swing sets, kiddie pools, basket ball hoops and such.

Also, some neighborhoods have an older population based on the density the City allows. Some concessions are granted to developers who build for over 62.

It depends on the community and the developer. The town/goverment rules superceded any developer but the developer could place a ccovenant on the property that exceeds the town requirement. That being said an increase in the age restriction is unlikely. Most town require one resident to be over 55, some require both so it is a town specific ruling. Be sure any offer you may make allows you or your broker to check this out with the town.

The simple answer is no. A town may set there laws at 55 or 62 as i have seen, they may also set it at any age in between. The hud laws work along with but also sometimes work againsty each other. Some scenarios are a 55 plus community may allow 20% of the occupants to be below 55 but no occupants under 18 or in grades 12 and under. Others may be 62 plus and no exceptions. The best bet is to check with each community you are interested in individually to find out their rules, and go as far as getting a copy of their condo docs, lease agreement, park rules and such. That depends. NH law permits on 55 plus communities that at lest one owner of the home be 55, however in 55 plus communiities there is an 80/20 rule. This means that 80% of owners in a 55 plus community must be 55 or more. Meaning that some unit owners under 55 may own and reside in the community. Each town however may restrict these rules to a higher degree.
In 62 plus communities there is no 80/20 rule and all owners must be 62 or greater. Should you need additional info please email me via my website

Yes. There are some HUD laws behind community like this. Keep in mind 55 of age is a "magic" number. Once reach that number, you got lots of discounted resources in this country ...

Another magic number is 65, once you reach 65 year old, you got lots of FREE resources in this country...
