Can someone tell me what this means in simple terms?RECORDING OF AGREEMENT. Tenant shall not record this

Asked by Douglas James, Amarillo, TX Thu Dec 13, 2007

Agreement on the Public Records of any public office. In the event that Tenant shall record this Agreement, this Agreement shall, at Landlord’s option, terminate immediately and Landlord shall be entitled to all rights and remedies that it has at law or in equity.

It means that you may not record the lease and make it part of the title. The reason for this is to prevent the tenant from causing a "cloud on title" which would cause problems if the property is attempted to be sold. By recording a contract there could be an implied interest in the property which would make a sale more complicated. Typically the only documents recorded are deeds and liens(e.g. mortgages, judgements, etc). This clause is to ensure no attempt is made to cause the above issue. It is actual a common clause that appears in many kinds of Rela Estate contracts. Consulting an attorney would be a good idea if you have further questions about whatever your particular situation is. Hope that helps.

It would be better to know what sort of agreement it is, but it sounds like the landlord does not want the agreement recorded (usually that means in the court system.) Care to elaborate a bit more?
