hi we just moved in a duplex a month ago and didn't sign a lease; the place is being forclosed.

Can we stop paying rent and move out

Help the community by answering this question:


If you havent signed anything talk to the owner and tell him you want to move if that is what you want to do or tell them to give you a discount on your rent till the bank forecloses on the house.

My personal opinion- Without knowing anymore details I would think you would be able too if nothing was signed.

I agree with Cameron, but as Aaron stated, this is really a legal matter and you're best bet would be to consult with an Attorney specializing in issues of Real Estate.

Without signing a lease you are in a tenancy at will which means that in MN you must give one month + one day's notice to the landlord in order to terminate your arangement. I would not stop paying rent but rather give the proper notice and find another place. I hope that this helps.

Until the bank takes it back, I would think that you would. It may be possible that the owner may bring the mortgage current.

Google (Insert your state) tenants rights...many states are now posting information to help tenants in foreclosed homes on their sites. Good luck.

I am not an attorney so this is not legal advice, but I've always heard that an unwritten lease is considered month-to-month and only requires 1 month's notice to terminate. Regardless of the home's situation though, you are required to abide by the terms of a lease you have agreed to, so simply stopping payment is not right.
