If a husband and wife own a building and our trying to lease it and only one signs the listing agreement is

Steve, in MN it's one to buy, and two to sell real property. I know that's kind of unrelated to your question, but my gut is both need to sign, go with Aaron's advice and make a quick call to an attorney.

I have e-mailed a real estate attorney and asked him you're question.....hope to have an answer for you tomorrow.

Not in North Carolina. You need to check with your agent. Each states real estate laws vary slightly from state to state.
