What Rights Do I Have If A Roommate Leaves Without A 30 Day Notices And He Or She Is Not On The Lease?

if the 30 day notice falls on the next month rent do he or she still have to pay rent for that month?

different areas, different regions have different rules regarding subletting. So best to check in your area specifically.

But without something in writing, it'll be difficult to prove either side. I doubt that the local constabulary will be much willing to mix in, without something written. And doubtful that they'd take your side, as there's nobody to "evict" since there is no lease.

They be less than likely to want to mix into a domestic issue. And you don't have much of a leg to stand on either, since you probably don't have a legal right sublet, without something written from your landlord.

It's a moot point since you are trying to get him to stay,not leave.However,if you have allowed him to stay without a written lease or consent from your landlord,he might have certain so called "squatters rIghts"

so we asked him yesterday he should give us a 30 day notice and he aid no. sense there is nothing in writing that he even live there..... can we call the police and get him to give us his keys and make him get his stuff out right now? or do we have to sit back and let him leave when he wants to. what im saying is sense there is nothing in writing like u said... is he basiclly a guest that we can kick out? and what do u mean by squatters rIghts? what do that mean.

so say we dont have nothing in writing but we have a witness which is his twin sister saying that he agreed to stay with us till 0ctober when the lease was over? can we take that to court and make him file a 30 day notice?

no because he is my girlfriend uncle uncle as in my girlfiends mother twin brother so we found it disrespectful to ask him to put something in writing. thats like asking my girl can i take a blood when my son was born as if i didnt trust her.. u get what im sayin?

What I mean is,did you & your roommate have an agreement signed by both of you that he is required to give 30 days notice?

he never wrote a 30 day notice he said monday that just passed that he was leaving next week.

Do you have the 30 day notice agreement in writing? if not you do not have a legally binding contract and no recourse. A verbal agreement is not binding.

Actually if money changes hands on an obvious month to month basis a verbal agreement is binding.
