Update: Agent & I discussed expired contract.

Agent says it's still on the Market & when I tell him to cancel it he will. I stated it's a legal contract that expired 1/6/08. He said it doesn't matter. I'm leaving it on the Market until I find a different Realtor. Why are Sellers advised use a local Realtor? I live in Des Plaines, IL.

I'm not sure I totally understand your question. If the contract expired on Jan. 6... and you didn't extend it in writing... then it's cancelled. Period.

Why are sellers advised to use a local Realtor... because local Realtors are the ones who understand the local market. This guy just sounds like a tool. Do a better job, when you interview and hire your next agent.

Hi Bette - if your listing agreement has expired and you have not agreed in writing to extend the listing agreement for a specific period of time, your prior listing agreement is no longer in effect and has been terminated.

In order for you to have a valid listing agreement it requires your written consent for a beginning and end period. Your listing agent/broker is incorrect. If your listing agreement has expired, he/she no longer represents you in the sale of your property, regardless of whether or not you choose to relist with another broker.

In Illinois, when a listing is entered into the MLS, it asks for an expiration date. The expiration date per your contract should have been entered at that time, and had it been, your listing would have automatically expired off of the MLS.

The fact that it didn't means that the correct expiration date was never entered.

Call the agent's broker and demand that your listing be removed from the MLS. Be sure to have your contract to refer to.

Did you use a local Realtor before? A local Realtor is often recommended because of her knowledge of the specific market, and her connections within the community. However, more important than local is an agent that will actually listen to your needs and respect your role as the homeowner, while at the same time providing counsel and honest guidance and feedback. The benefits of a local agent are cancelled out if that agent doesn't possess these qualities. Find the combination of both and you're set.

I thought I remember Patrick Mahony, another Top Voices and a Realtor, referring an agent from Des Plaines. I found the post. This is what he said:

I moved from Des Plaines a few years ago. I had the worlds greatest Realtor sell my house.

She is a Realtors, Realtor.

Bette - Please review the contract - in my area, the contract terminates at some point unless it is amended and extended further - Call the Managing Broker of the office and tell that person your contract has terminated and you want the marketing materials removed; if this agent is the managing broker, then tell him to either terminate the contract or you will contact the Real Estate Commission in your state.

We advise you to use a local Realtor because the vast majority are not like this agent - the sale or purchase of your home is too big to work with someone who is not familiar with the area and a local agent typically is familiar with the area - if you read this forum frequently, you would have to agree that you probably would not be experiencing this if you were working with one of the many prorfessionals that respond to these questions. Keep us posted on how it goes.
