Am I legally bindied to a mortgage broker?

Asked by Danny, 53558 Fri May 1, 2009

For our search in working with a Mortgage Broker, we had chosen an individual who presented himself well when we met him face to face. We have not signed anything, no documents, but I have emailed him stating that we were going to go with him. It's been over a week now and he has not returned our calls or emails. Are we legally binded to him, even though we did not sign any documents to verify that he was going to represent us? Like I stated above, the only thing is I sent him an email saying that we were choosing him as our mortgage broker. At this point, we are thinking about dropping him because he can't even return our calls and emails to answer a simple question like "how is the loan process going?"

No you are not obligated to any Mortgage Broker. If you had given him an application fee or something of that nature I might advise you to rethink losing that money, but since you said nothing has been signed then no.

On a side note, it's possible that he may be having a family emergency or something that is preventing him from calling you back, so maybe give it another few days to see what happens.
Otherwise I suggest you move on.
