Realtors; are you being set up?

If you are worth your weight in salt, you are aware of the fact that consumer groups and opportunists look to boards, forums and blogs to find a possible target. With this in mind, have the contributors here changed the way they look at blogging or posting to forums? Have any of you had a first hand experience that you would be willing to share?

Johnathan. You are making an excellent point here and I have to admit that I do wonder from time to time if a question has been posted as a trap. I also have to admit that I have become more selective in choosing the questions that I answer here, not so much out of fear of being trapped, but because I have come to the realization that answering some questions is not time well spent and then there are those questions that have already been answered a 100 or more times.
Thanks for asking this question and bringing this to the forefront. There are definitely groups out there who are trying to capitalize on this kind of activity. They don't need a case with merit. They just need a case to extort a settlement.

I think most Realtors know the law and abide by it. Sting operations have been going on in one form or another for a long time. I don't have a problem with that but it does make you wonder when people ask "what's a good neighborhood......" how much is the standard commission....." can you give me legal advice on.......... "What do you think of my Realtor doing......?”

I think this guy might be a DRE implant.

Not that it is a concern but you might want to now be aware that this can happen.

I think that's why you are seeing some of the answers like, and rightfully so, disclosures, disclaimers, you need to check with your CPAs, Attorneys, please provide more details, and referrals of certain sites.

Consumers might think those answers are cop outs but that's both the best answers a Realtors can give (for accuracy and sound advise and also precautions we have to take due to what you are talking about.

Sad part is that all these mentality and behavior are part of what drive the cost up for consumers in a lot of things..

I have seen situations that really make you think about this. I do know of a group of attorneys who are gong after Realtors and Brokers in San Diego. Very rarely is there anything that they have really done to "wrong" the consumer but, like Ute mentions, they don't need merit to extort a quick $5k out of agents and their insurance company. All suits, frivolous or not, take time and money to fight. Time and money is something that none of us want to waste. Both C.A.R. and N.A.R. warn us of this practice and provide some good advice on dealing with this sort of thing but, since blogging is such a new phenomena, we all could end up as poster children for a precedence setting case. I don't run scared as a result, just a little more cautious. Is this question a "set up"? :)
