DT, Both Buyer and Seller in 78737

Zoned duplex but has third unit included?

I have searched city/county websites for hours but cannot find any info on fines/recourse if a lot is zoned for a duplex, but has a third rental unit operating on it. This is in Travis county of Austin.

Help the community by answering this question:


To be honest I think he just built it.
I know he has no problem renting it out. There is always someone living their.
I will have to check his zoning. He may have changed the legal to Condos. I know that would work.
I still havent got an answer back yet, but I do like the title co idea.
Here are all the zoning laws.

Thanks for the replies so far.
@Margaret - I have actually done the zoning/overlay/neighborhood plan search myself and already know that the lot is only zoned for a duplex. I guess just to be safe I will look at the numbers without the efficiency as a valid unit and decide if the property would make a good purchase.
@Jeff - thanks for the feedback. I'd be curious to know if he's zoned for that and had any problem with the buildout and rental.

Do you or your Realtor have a good relationship with a Real Estate atty that does closings in their office or with a title company. They are the ones you might have research this. It may take a few dollars.
I know when the seller needs to find something our before selling ( title policy wise- which this is) I do a contract with the buyer being "to be determined" and pay the title company $25. to go ahead with the search.
Maybe you can do something similar.

I know a neighbor of mine that has a duplex and then he put a garage and Apt in the back.
I know he did not have a problem.
I will take a look and see what I can find.
