No response on offer- stated on offer to respond w/in 72 hours.

My fiance and I made an offer on a home through our real estate agent. He had been in contact w/ the broker and was told there were 3 other offers on the property. We really liked the home so we made an offer we felt was reasonable and our agent submitted it to the broker with a "respond w/in 72 hours". It's been over 72 hours and he has heard nothing back from the broker, not even to say our offer was rejected. He has called her several times and she has never responded to his calls. On the off chance that maybe her phone was down or... I dunno... she was in the hospital or something, I called her today and left a message just simply saying I was interested in looking at a property and asked for a call back for some information. She called back within 20 minutes. We're not really sure what's going on or what rights we really have. We're getting very frustrated. What do we do?

Hello Melissa. I am just wondering whether the offer you submitted was for a bank owned property. It's not uncommon for banks to respond to offers whenever they are good and ready. If there were multiple offers, they may only respond to the offer they end up accepting. I am not trying to excuse the agents lack of response. I think they should keep the agents who have submitted offers up-to-date even if there is no response yet. I know first hand how frustrating it is when I can't get an agent to return calls and then my client calls and the agent either answers the call or calls right back. It makes me look bad and I consider it unprofessional. Unfortunately, unresponsive agents seem to be too common. I have dealt with a lot of very busy agents and some seem to still respond and others just don't have timely replying on their priority list.

I just wanted you to know that what you experienced is not acceptable but unfortunately not rare either. I hope you'll receive a positive reply after all. Good luck.

First of all you must understand that the listing agent has a fiduciary duty towards the seller (his client). You might have submitted an offer that YOU believe is fair but if the seller is so put off by the offer he might instruct his agent to not even respond to it. I don't know where you live but in Texas this is perfectly fine to not respond to a low offer. Much of the time low offers waste a lot of time and some people just don't have time to deal with them nor should they be forced to. Two bottom lines here: If you want a better response, submit a better offer. And, remember the listing agent works for the seller not you.

If that's how one conducts business I would avoid that agent and also tell my friends and family about them. One's reputation is all we have. Yelp reviews also help. In business one should not let emotions get involved. All offers are appreciated and one person's value may differ from another. Common curtesy goes a long way.
