Anyone have info on foreclosure firm Millsap & SInger?

Hi, We have a contract on a house (for over a month now) and we just learned that it has been in foreclosure by seeing an ad in the paper to be in a foreclosure sale in two weeks! The realtor swears she did not know and the owners keep saying "we have talked to our bank and they say its okay"...but no one has faxed copies of our contract, our bank approval, or nothing! We have already paid for appraisal on this property, the title work has been done...we really don't know what to do! No one will give us straight answers! Please help....our house that we are selling is set to close in 22 days and we will be out on the street!!

Hi they do not stop they forclosed on my home and bank of america stated that they will stop the sale because they could not give me a reinstatement figures..... I dont know what to do because the bank gave me $6,009.00 and then 20 min before the sale millsap gave me 6700. I had the 6009. but not the 6700 and they sold it.

Millsap and Slnger are not going to be your saving grace, they have just been hired to get the property to the doorsteps of the courthouse and take care of legal work. The agent that was representing the seller should have done a short sale. You will have to have the agent representing the seller get an autorization to release information for the lender to get in touch with them. There is a laundry list of things that they will need to get this moving forward. The only way to stop this is to have the bank stop it, it can be done and you still have time. Millsap and Slnger can only stop the proceedings or push the sell of if the lender tells them to. The only postive to this is you may be able to get a better deal. Keep in mind that Millsap & Singer is the trustee for the foreclosure, not a direct conduit to the owner.

Yes, we have had an executed, binding contract with these folks since June 14. They HAVE TO HAD known they were getting ready to be foreclosed on, because they told the realtor they "wanted a quick sale". I have heard these trustee folks don't play, and they aren't just going to "take the owner's word" for it that he has a contract on his property to be closed on a certain date. Besides, because of the privacy act, the bank or trustee firm won't talk to anyone but the owner of the home...so basically, realtor is telling us that she has to rely on the owner to give her straight facts....this is so scary!

WOW sorry to hear what has taken place. My question do you have an executed contract? If you do have an executed contract a bank would rather sale the property than a foreclosure. I would recommend for the listing agent contact the bank stating an executed contract is on the property.
