Help! Home Inspection Question

I bought my Condo in the winter, my home inspector said that they could not check the AC unit because it was so cold out. He did look on the OUTSIDE of the unit, but that was it. Come summer, the unit does not work at all. The insides are so rusted, the WIRES are actually rust. I thought we whre convered unter the contract, but my lawyer said unless it was fraud, it was my job to get a heating person to inspect it (My agent did not tell me that, but she was also the selling agent)

My question is 2 part, the person installing the unit said there was no way it worked last year, if the person selling the condo did not LIVE in the condo would it still b frauid? and should the home inspector have OPENED the unit?

As a home inspector we don't open the ac unit, we do a visual inspection of the outside also. We have several ac units that we were unable to check out because of temperatures below 65. In our training we are taught that turning an ac unit on when it is below 65 degrees can damage the unit.
