I would gather all the paperwork you signed when you hired the agent and see what you are obligated to in writing. If you signed a buyer agency contract any fees should be detailed in writing. If you only signed an agency disclosure form then you would not be obligated to pay anything. If you still have questions about the contact you could contact the owner broker of the real etate company. Next call would be to a local attorney specializing in real estate. Cheryl, I see many answers from all sorts of agents from all sorts of locations throughout the country, myself included. Taunton is typically a tougher market as most of your major retailers are on the Raynham side coming into town. So much has to do with your exact location and the amount of land you have. The commercial market is not hurting right now, there is still very little well located commercial property available for sale. I can give you an experts opinion if you want.

You may want to ask for one more extension- maybe an additional few days. Talk to the owner of the mortgage company as well- if its a small company. If not, at least talk to the branch manager of the loan company. They have to feel a little of the pressure that you're feeling as well. Or they should be.
Part of your P&S is a mortgage contingency. If you cannot get the mortgage by the specified date, and you have done everything that YOU can do, legally the RE company cannot keep your down payment. Check your P&S wording and the dates in it. Check the financing contingency.

As Greg mentioned below, refinancing your first, and subordinating your second is propbably your best option. When you finally have the equity in your home, then you can roll the second in.

First, you have to get a variance from the city to be sure they will approve the conversion from one to two family. My opinion is value will not be affected greatly due to the large number of multi-family homes on the market in this area. Rentals are not in short supply in Taunton. Converting could be quite pricey.... more

How many days are you into your contract and have you signed off on your contingency yet. There are several steps to the escrow period. As long as you are still in the 17 day contingency period you are good although it is posible if the seller is a bank it was reduced to 10 days. If the house has an HOA have you gotten a copy of the CC&R's yet at which time you can also back out and keep your deposit maybe minus some charges.... more

Delig, sounds like you'll want to speak to an attorney. Talk to your agent about the listing sheet as "subject to seller finding suitable housing" should be disclosed as well. This is also something that should have been on the P&S with a cap date.... more
