The tenant is responsible for curbing their own garbage unless there is an agreement in the lease stating otherwise. That is very rare though. It is almost always the tenant's responsibility to take care of their own garbage. However, if the tenant screws up and doesn't curb their garbage properly, the landlord could be held accountable and fined, even if he's not responsible because it's his property.

Hello Hallpass,

Unless it specifically says otherwise in your lease, the tenant is responsible. If you used the standard NJ form it is the tenant. I am having a hard time figuring out why the tenant would be giving you a hard time about this.

Garbage is responsibility of tenant. Its your garbage.. Unless there is a special agreement you have with landlord, not likely.

But if tenant does not comply with town regulation landlord can be held responsible for fines as well as the tenant.

typically every is responsible for their own garbage. It all depends on the agreement you have and the type of building you live in.
