Stay away, unless you like giving your money away to crooks. There are legitimate homes for rent on MLSlistings.com, just not very many.

You are better off contacting established property management companies and real estate agents that sell homes in the area. Sometimes they are aware of opportunities before they hit the open market.

The advertisement says the monthly rent that they are asking is only $800 per month for that apartment.

That is less than half the fair market rent for that apartment in that location.

Yes, that is a scam. Unfortunately there is such a shortage of housing here in San Jose, that a number of scammers post advertisements like this one that are too good to be true. They get many calls for people who are desperate to find a place to live.

Currently there are some people who take the information for a property and post that information as if it were their own, property or as if they are acting as agents for the owners, even though they do not own the property and have no agency relationship with the owners of the property. These advertisements are placed without the knowledge of the owners and without the knowledge of the agents for the owners of the property..

They post ridiculously low rents. That results in large numbers of desperate people calling about the property.

The scammers then persuade the people who call, to send them security deposits and prepaid rent for the property. The scammers then disappear with your money.

This is a particularly cruel hoax because they have now taken the money that you need to pay your security deposit and prepaid rent. Victims of this scam often are left without a place to live, and no money to pay security deposits or prepaid rent.

You are very smart to question this advertisement where the rent that is advertised is so far below the fair market rent.

One of the best ways to protect yourself against this scam is to ask them for their DRE License number. The scammers are not licensed and will not be able to give you a valid DRE License number.

If they claim to be the owners of the property, it is easy to go to the County Recorder's Office at 70 West Hedding Street in San Jose, and look up the true owners of the property. You will find that these people are not the owners of record of the property, even if they claim to be the owners of the property.
