What are the limits in how many people can share a 4 bedroom rent stabilized apartment in NYC?

Asked by Alan Leventhal Claire Richard, New York, NY Fri Feb 8, 2013

I understand that the leaseholder can't charge any more than the legal rent.

Hi Alan,

NYC occupancy law prohibits more than three unrelated people from living in an apartment whether it's rent stabilized, market rent or a condo or coop sublet.

While common, it is illegal in NYC for more than three unrelated people to share an apartment.

Mitchell, Thanks a lot. I live in a 4 bed pre-war stabilized apt and the LL is hassling us. We probably need to get a good lawyer Alan .
