We just signed a lease and during move-in we noticed that the central AC isn't working properly. Can we withold rent? Can we get our security?

deposit? When we were shown the apt it was advertised with central air. The unit isn't installed properly and will just run constantly without ever cooling off. So it's been running for 2 days straight. The mgmt company claims that they never had issues before but people have window units in the top floor to help cool it down. We don't know if we should break our lease or withhold rent. Can someone help guide us on the best thing to do?

Just work with your landlord / mgt company. Let them know the issue so they can repair it. I wouldn't play the games with the rent yet because you just moved in. Why start the relationship the wrong way by playing hardball. This central a/c issue should have been checked prior to the landlord renting the unit out. Write a letter to the landlord company requesting this item be fixed. Read your lease agreement as well, it will outline if something like this does come up, who's responsible for fixing it....

Please check your lease.
Before signing the lease, tenant has the right to inspect the resident and provides a list of repair. a punch list is also necessary a few days after moving in. Review lease for the repair/maintenance responsibility and inform landlord asap in writing.
