IF you have a lease that is a legal document and stays in force with the property even when sold. I'm not an attorney so I can't advise but as a landlord and Realtor I know that a lease cannot be broken with a sale or shortsale. Read your lease terms and show it to your attorney to be sure.

If they can rent it out, they may not need to short sell it. I have numerous clients who are in the same position and will be able to avoid a short sale by leasing.
