HOA Lien on rental property.

Asked by scottheidi, Orlando, FL Tue Jun 11, 2013

We are currently renting a house from a property management company. Our rent is current. The HOA association has placed a lien on the house because the property management company has failed to keep the HOA fees current (American Homes for Rent). Can I be evicted by the HOA association? Can the management company renew our lease with the lien in place?

A lien just puts a cloud on the title so that if the owner sells they have to pay it off. The HOA could file for foreclosure, but that would involve the owner and not you as long as you have a lease. If the lease expires the owner could ask you to leave, but not the HOA.

A lien doesn't mean a whole lot until the creditor acts on it. In this case, I doubt the HOA will do anything. The property owner will have to settle the lien.
