Thanks everyone, I should have clarified that yes we would be accessing the beach from the public access point but had heard even though it is a private community that the supreme court ruled that as long as you were within 20 feet of the shoreline you are able to be on that part of the beach. We are a couple in our forties looking to relax at the beach on vacation and would prefer a bit of space, not looking to stake our umbrella and chairs in front of someone's beach house. Viewing the webcam yesterday it looked super packed at the beach at James Lee Park.
Destiny by the Sea is gated and closed to all outsiders. You can access the beach at James Lee Park (the Crab Trap) or to the East of Destiny by the Sea. You can use the beach in front of Destiny by the Sea up to 15 ft back from the high water line without violating their "private beach"--at least that was the last piece of information that was given to me by the Sheriff Department. Saying it is "private" beach doesn't necessarily make it so. You still have to access it with a public beach access point.

Destiny by the Sea is an independent community. they do not allow beach access to others. The best way to get to the beach from DE is via a golf cart path and under the road to park on the west side of DBTS.
