Elena is correct that the owner must disclose if a notice of default has been filed. The link I show above is in an apartment complex and I do not think they are in foreclosure. Many properties with Notice of Defaullts filed do not go into foreclosure.

This home is listed as a rental with the option to buy. It is supposedly in foreclosure. Who is listing it for rent, the owner or the lender (1st or 2nd?)? Who is advertising the specific rent amount? Why is there no contact information? I happen to live in the area, drove by and it is occupied.

Yes, they can. My understanding of the current law is that they have to disclosure the pre-forclosure to the tenant. But other than that - no limitations.
