In Alabama, a lease survives the sale so unless the home is a foreclosure, the new purchaser must abide by the lease. Rules are different for a foreclosure.

Until their lease expires, if that is longer than 90 days you cannot use an owner occupied mortgage to finance the transaction. Good luck,

Every lease is unique. You would need to read the lease for the property and tenant in question.
