kellinger, Home Owner in Rockville, MD

My tenant moved out 12/31. I sent him a list of damages and returned part of the deposit. The check was cashed, now 2 months later he wants the rest.

Since he cashed the check without alerting me that he disputed any of the charges is request reasonable? the partial deposit was returned within 25 days of him vacating.

By cashing the check, the tenant did not give up any rights to dispute.

As long as you can prove when the check was mailed, included an itemized list of what was withheld/included in the check amount, plus can show receipts for any items you deducted from the deposit, you're fine.
