I am renting a house for almost $3000/mo!!! with a mold problem termites and garbage under the house, there

is also a mouse problem that has caused me over $1000 in damages. The landlord did not disclose this before move in and that he will be storing his junk under the house. He also did not get the house properly cleaned and it was a disaster when we moved in. he has been cleaning it for a year now and none of the things he promised are being done. The tub outside not fixed the microwave rusted out and he wont replace it. The fan has no petals just to name a few things. Can I force him to do any of it and does any of this brake the lease because seriously I want to move out!

At $3,000 a month you should be getting a pretty nice rental. I would definitely look at my lease contract, if I was you, and define a couple of good violations that your landlord has made. You have to remember that your landlord may have already breached your contract and should have relieved you of the burden. If so, I am positive you can find a nice rental for $3,000, probably less.

Joanna, under the tenant rights, you have more than ample cause to break your lease or make the repairs and deduct them from your rent. Homes have to be kept in safe condition and if there is a health concern, your landlord is creating a situation where he/she may be exposing themselves to added liability by not repairing hazardous conditions. Try to move as soon as possible and yes there are remedies for small claims against mold and these issues-we were living in a house in Cayucos that had mold (the owner was a doctor at Sierra Vista-the place was disgusting!!) the health concerns of my kids and us were terrible-constantly sick, allergy-type illnesses, headaches-there has to be a lawyer or some information on the internet or in the CA tenants handbook it does talk about disclosures and good faith-so please look into that-but I urge you to get away from the mold and $3,000 a month that is CRAZY!!!!

It seems to me that you have more than enough cause to break your lease. Nevertheless, I would check with a Tenant's Attorney before doing anything. I have seen professional landlords that are full of tricks and can take you to court.
