I cannot get a response from Bank of America regarding my 203 k loan with them! I have contractors about to stop working...any advice?

I was in the Taylor Bean boat, and secured a home (foreclosed) loan with a 203K mortgage, May09. The home had no furnace, A/C, water heater, kitchen appliances or lighting. The 203K was used for hvac and appliances. My loan was transfered to BofA with a really smooth transition, Aug09. I just got a letter of demand for payment, from hvac contractor, because the TBW final disbursement check sent to hvac contractor bounced. The job was completed in May09. All this time, the contractor has been trying to collect. Now I'm under fire to pay this invoice.

Any info on how i can avoid paying for the hvac twice (its already figured into the mortgage)?

well, about a week ago we got our final check for the contractor. We hadn't heard if they were going to grant us our 10 percent holdback for the changes or not so we were scared to death we were going to owe $2,000 out of our own pocket, but we miraculously got the whole thing and ended up owing $7 out of pocket. Sure, it was four months after closing but I guess all's well that ends well!

Some keys to this entire process, as we're finding out now, is as follows. As everyone knows, there are some simply 'once-in-a-lifetime' deals on houses NOW, because of the huge drop in the housing market because of the recession; a ton of these are foreclosures. We bought our house for $85,900, which was valued/appraised at $274,000. We're having approx. $33,000 worth of work wrapped into the 203 loan; mostly energy efficient items such as roof, insulation, and quite a bit of interior work (kitchen, baths, elec)

1> Don't go through a bank. Change to a Credit Union now and use them to process the loan. Banks still
cannot get things moving because of issues with national banks further upstream from you. Bank DO NOT process the loan with the customer (homebuyer) in mind on 203 loans. Credit Unions, particularly those you're already a member of, are (IMHO) one of the last responsible financial institutions left in the USA (honestly - most work for you). They tell you upfront that these loans require patience, optimism and understanding.
They're giving you money, aside from the $ they're paying the seller, upfront to pay for improving the home - like putting your head and tail in the chopping block at the same time (if you're a CU).

2> Get to know your FHA HUD 203 advisor/consultant very well - they are the ones who normally
know the 'Disbursement' processors at most of your regional/state credit unions and banks. They will guide you through every step - Ask questions at every step and don't be afraid if you're asking too many!!!!
For the most part, their #1 goal is to make sure the home is safe/sound and ready for a family to move in - while also looking out for your interests in the matter.

3> Don't expect the process of getting money to the contractors to be expedited, quick or non-cumbersome.
It normally takes a minimum of 10 days to get any funds after you close anyway. That's 10 days that no work should occur in (if the house isn't habitable yet). If contractors require money for materials upfront (typical with the best of the best, who have no overhead, warehouses of storage areas - this is how they do top notch work that totally undercuts Home Depot, Lowe's and the BIG construction operations)

4> Don't sign anything until you've gotten all the answers (in email or in writing) from your 203 consultant, credit union and your loan processor. It never hurts to ask questions before you send those requests for the 1st draw, Waivers of Lien or the Change Draw (if you have a contigency set up).

5> Fully understand which type of 203 you have - which is primarily based on the dollar amount of work
you're having done. Is it a FHA HUD 203k (Express) or 'Full' - the main difference between the two is how much $ in work are you having done to the new home. If you fall into the 'Full 203' category, which bank and CU loan officers may not tell you, then you CANNOT take any money from the loan to give to the contractors for purchasing materials upfront. The money only will come after the 1st inspection draw. You and the contractors you choose must know this (the contractors) up-front!!! Very few contractors (except the BIG and $$$ ones) will pay for the mats themselves; and if they do, you WILL be paying top dollar for everything!!!

6> Know that most loans of this type are SOLD off immediately after closing to a national bank - which will delay you anywhere from a month or more from allowing the money and work to begin. Don't plan on a moving date for the new home unless you already have money going to the contractors from the disbursement officer at the CU. I'd recommend setting a date when 50% of the work is complete and the contractors have received at least 50-60% of the money due them.

7> If you receive a gift of money from a relative, family member or a stranger - there are requirements as to "who" is allowed to gift you money for use towards the down payment, closing, etc.. It must be a family member, and they must sign several docs proving who they are in relation to you, that the money is a gift and doesn't expect to be re-paid, and that they don't have any interest in the new property. If the last names of you and that family member are different (divorce, remarried, death, etc..)YOU must prove who you are
in relation to that family member (provide SS card, drivers license, birth certificates <<originals>> ) which gets complicated if they don't live in the same town as you.

Lastly, do your homework on the .GOV site for these types of loans and on Internet forums such as this.
IMHO - many of the rules and regulations for these types of loans are in desperate need of updating, and should be overhauled to lessen the burden of overwhelming the buyer with unneeded documents and huge gaps in waiting for things to happen. Be VERY mindful of your closing as we had to move ours twice because there was soooo much paperwork involved.

with regards to interest, i got a response from BOA that is listed below:
on the Taylor Bean files, they didnt send any interest to us. So we are unable to pay interest when we didnt receive the funds for the interest since we are only sub servicing them on behalf of Gennie Mae. You will need to file a claim with the Bankruptcy courts.

Does anyone know when B of A is supposed to issue the check for the interest accrued on the escrow during construction? We chose to have that money issued to us and we have not received it - we received our 10 percent holdback about a month ago - fortunately, we're done with the process except for the interest accrued that they owe us. I don't want to let them keep one cent from this transaction for what they put us through.

Soon, I'll be closing all my B of A accounts and moving to credit union! Can't wait to be done with them.

The delay is because B of A purchased Countywide last year and CW was one of the two largest 203 (k) funders in the country. B of A was originally taking two months to begin funding these loans after closing and now they're down to about 30 - 40 days. We do many of these rehab loans at Evergreen Home Loans in Seattle and we have seen the time for initial draw decrease over the last few months. Nothing close to perfect, but it's getting better. They truly had a learning curve to get through.

I actually enjoy doing 203 (k) loans so much so that I'm writing a continuing education clock hour class for realtors.

Even though I live in MA that is where my loan is being processed out of. It's been well over 60 days and I still don't have my first disbursement. Apparently the hold up is now with accounting due to a vendor number? This is such a joke.

I received my final check and this whole nightmare is finally over. After all of the headaches, the person who helped and remained in daily email contact was Dominique Osborne.[dominique.osborne@bankofamerica.com] She is an angel.

My advice: send, short and kind emails with your loan number and full details requesting a specific action and/or update on your status. Request a read receipt and keep a paper trail. Email is way better than calling. Always remind them of the completion deadline on your loan paperwork (mine was 6 mos. post closing)

Here was an overview of the process :

*60 days after the loan is sold to BOA (not closed w/ original bank) I received a 50% dispersement via Federal Express. I think my calling and complaining was purely coincidental and this process just happened on its own--but at the time I thought I got the check because of my repeated attempts to get a human
*With the check was a "Letter of Completion" that you sign after the contractor is 100% done
*Send the Letter of Completion and all final invoices (or receipts if you had to make payments) via Federal Express or UPS to the address on the Letter of Completion.
* They will then order an inspection. If it does not happen get proactive and check your original appraisal report. The same appraiser is supposed to come back out.
*Then BOA is supposed to order a Title Report to check for any liens (in case your contractor put on one your property) They won't release the $ if there is a lien
*After the appraisal and Title report come back they will process a check request and Fed Ex the final amount

I have been reading through these posts and find myself in the same position. My family closed on a house in August. Within a week our mortgage was sold to BOA. We planned of having the renovations paid for in 2 draws. The first draw request was a total pain. Like everyone else I could not get a hold of anyone in the 203K disbursement office. I left messages and voicemails to no avail. It got to the point where I was discussing other options with my lawyer and was on the verge of entering suit when the check suddenly arrived (just over 2 months after the request and $500 short) with no heads up or anything of the sort. We were able to pay our contractors and they finished the job. Now we have been waiting for the second and final draw request for almost 3 months. Once again no one can be reached to update our situation.

This is unacceptable. My attorney has instructed me to try to find others who would be interested in a class action lawsuit against BOA Home Loans Servicing LLP for breach of contract. I have a handful of names already but if anyone out there would like to join me in taking the fight to BOA, please contact me at drewhelmke@yahoo.com. I imagine that you like myself have a million things that you would rather dedicate your attention to but for the sake of all the future poor souls who find themselves in this same position we must fight back.

I'm in the San Francisco Bay area... and I am frustrated with Bank of america as well!!!

I can't beleive there are other here that are having problems with Bank of America. I am a contractor and I have been calling everyday... I never miss a day and I cannot get any anwsers on status on final disbursments. WHO EVER IS ORIGINATING THESE LOANS SHOULD TAKE ALL OF THESE COMPLAINTS INTO ACCOUNT!!!
Tammy and Vince are the ones I've left voicemails for and they havent even responded.

The rep always tells me that it takes approximately 30 days to disburse funds...then I tell them it has been more than 30 days... they appologize and they tell me that I have to wait. This is ridiculous.

If someone decides to build a case against BofA in California, please post here again. I hope that future jobs won't have to be like this for all contractors.

My 203K closed 8/26 with BNC and it was sold to BOA and I did not get my first disbursement until 10/26. I emailed (provided by BNC) carola.sherman@bankofamerica.com after I could not talk or leave messages at the 203k Department. I am now waiting for inspection and final disbursement. I had faxed the "Letter of completion" 3 times. I emailed BOA's housing department stating "I paid mortgage payments on a loan that was not being honored by their bank. I also threatened to discontinue making future payments".

Today, I faxed the receipts, invoices, letter of completion, and city inspector reports again to 803-306-7041 with emails to carol stating "Have faxed "letter of completion", invoices, receipts, and city inspections to 805-306-7041.These papers have been faxed 4 times but I have not received any acknowledgment that it has been received.Really need to get funds that I have paid and funds my contractor is owed before he puts a lien /sues my home.Guess I will start faxing it everyday." Carol emailed me back "Sharice will be contacting you shortly."
Received a call from Valerie that the faxes were received and an inspector was notified and an inspection was ordered. Also gave the inspectors name and what documents she will have to send to BOA/HUD. The inspector is the same as the one who did the appraisal ....NOT the HUD consultant.

We will see how long this all takes.. Will give updates as they occur.

We finally got our welcome packet and the letter of completion last week after requesting it for 3 months. I was just looking around on the internet and managed to find it on HUD's website for everyone in the same boat.

You need to file this along with contractor's invoices (especially those you've already paid out of pocket) to get the second disbursement and schedule the final inspection. The BoA form is slightly altered.

At the top it says BORROWER'S NAME

PROPERTY ADDRESS

TODAY'S DATE:
CASE NUMBER:
LOAN NUMBER:

My name and address are all in caps, while the date is written out. Then it continues with the Mortgagor's Letter of Completion... etc.

My loan closed in July and I still do not have the second disbursement. I called of 100 times one day before I could get a hold of someone. I have several phone numbers any of you can call to get some info. The first is 1-866-921-4764, this is the easiest one. The other is 1-800-293-8155 and the following are the extensions I have used so far: 5340, 5478, 5347, 5464, 5221, 5465 & 5446. The managers name is Carol Sherman but you can not contact her. I agree with the other person who said that file a complaint with FHA and get their license revoked to do 203K loans. DO NOT go thru a company that sales the loan. Only go thru a local back and this will go much smoother. My contractors are being patient but only because I update me almost daily. This loan has consumed every ounce of time and Bank of America needs to never be allowed to do this type of loan again. I have rarely spoken to the same person twice and it seems that quit within a few months. Problem would be solved if they had the staff to handle the load but from what I am told they have very few people working the whole US. The FHA number to call is 1-800-225-5342.

I really believe that the complaints should stop being made to BofA and done to HUD. There is also a governement agency that regulates them. With a simple scroll of all these comments, one can see how many people are in the same situation. They continue to make billions of dollars and buying other banks while they are not complying with their own contracts (loans). This is not simply bad service but rather a breakdown of their duty to perform the actions stated in their loan docs.

Don't call them to complain - call people who can punish their actions by fines and sanctions.

So has anyone actually found out who to talk to at boa or it just doesn't do any good? I'm a contractor in MN and have been trying to get my final check for about three weeks. First I was told that they didn't receive all the paperwork. Now I've been told that the matter has been escalated but still cant talk to anyone other then "the call center" because the 203k dept. is so behind. Auggggggg!!!!!!!!

I would advise to go to the top as soon as you get this loan as the 1-800 numbers they provide are useless. Several weeks after submitting our initial draw request, representatives stated they had all of our information and that it would be processed within 10 days. As this was not happening, I requested to speak with a supervisor. They cannot or will not give you a supervisor's name and state they do not have their phone numbers! I escalated the case (whatever that means) but it wasn't until I emailed a supervisor, Ms. Riggins (listed on this site - thank you!) that I got a response. At this point, our contractor had walked off the job due to lack of payment; also leaving our home partially exposed to the outside in December. After contacting her mulitple times they stated they did not have the necessary documents and they had to be refaxed; further delaying our payment. I inquired why other staff would have verified it as being received several times and they stated they could not speak to that and that they "are located in another building". Unbelievable! It took 5 weeks to get it from time of submittal.
I am not sure if it is intentional fraud they are committing or massive ineptitude, but once you have a supervisor stick to that person like white on rice. We currently fax all of our stuff directly to Ms. Riggins and got our second draw in a (fairly) timely fashion. We have also filed a grievance with HUD and our state's Attorney General. This site has been really helpful for me - thank you.

Does BOA think their apologies are worth anything? Seriously, if they were really "sorry" they'd be working overtime until they caught up with their legal obligations to the loans they gave out. Their lack of competense and/or action has cost us several hundred dallors and a lien on our house!!! We got our final dispersement on Dec. 18th. and the check STILL has not cleared. Our personal bank tried to call and verify funds and after being on the phone with BOA for an hour they were told BOA couldn't give them any information!! BOA apologies are not worth a thing. Action and money are the only things I am interested in from them! BOA scripted "apologies" are a complete joke! So are their managers and so call "escalations."

That is sooo funny Craffi because I spoke to Jocelyn for the first time today! She kept apologizing too! She told me it will take about 3 weeks for our loan to get into the system and possibly 10 more days after that. I also told her that it is plastered everywhere that BOA has problems paying contractors and I asked if I would be experiencing the same issue. She obviously tried to side step the question and she told me within 10 business days of submitting a withdrawal request we would receive a check. I don't know what to do and no one can help us because we're not in the system!!!!!!!!!!!!!

I have been trying for over 30 days to schedule final inspection. When I called in to the 866-921-4764 number today on 12/31, Jocelyn began to read me the same script of apologies that she read to me 4 weeks ago. At the beginning of the month she said that someone would be calling me in 2-3 days for final inspection and that she would escalate the issue. After that, she attempted to sell me a credit card. How's that for Customer Service?

2 weeks ago when I called in, I spoke with Ian, a manager, who also said in 2-3 days I should hear back from somebody regarding final inspection.

Today on 12/31, I let Jocelyn know that I wanted to speak with her supervisor. She informed me that her manager Zakiyyah would only be telling me the same thing that Jocelyn told me - that the issue would be escalated and I could expect a phone call from someone within escalation in 5 days. When I told Jocelyn that I wanted to speak with Zakiyyah so that she could tell me that herself, Jocelyn put me on hold. She came back and said that Zakiyyah would not be available to take my call. I asked Jocelyn if her manager Zakiyyah was refusing to take a phone call from a customer. She put me on hold again and when she came back said that Zakiyyah was on another call and would not be available. I pushed Jocelyn to get me in touch with another manager, and she transferred me to Brittany.

Brittany informed me that the entire 203(k) department is approximately 30 days behind schedule and had been since at least the beginning of the month. I asked her why no one was able to share that with me until now, and she informed me she could not speak to that.

On both my conversations with Brittany and Jocelyn today I informed them that I had the phone number for the office of the CEO and would do my best to work within the system to get answers. Since I was not able to get anywhere through the customer service department, hopefully going above them to the CEO will allow me to get something done.

Brittany, Ian, and Jocelyn all work in the Plano office and are Bank of America employees, not contractors.

we bought a HUD house on the 10th and our loan was sold to BOA that same day! We have been calling BOA almost everyday and they still don't have us in their system yet. We have a 203k loan also and HUD gave us money to remove the lead. Since we're not in the system yet we don't have access to any of the money to start the rehab... that means we'll be paying our first mortgage payment for a house we can't move into.

To update my case on the streamline K, my husband was told he would be called back about our first dispersal last Friday. They never called but we did get the check from FedEx with NO warning! The also sent us some info about the final dispersal. So at least we got the first dispersal, hopefully they'll give us the last one without a fight.

My significant other has his 2nd house financed with BOA. They completly changed their website now, and when he makes a payment (which he pays additional to principle each month) the earliest they will credit the payment is 5 days after making it....so weird. So he has a 800 credit score, perfect payment history since the loan orginated and he got a late payment ding because BOA doesn't credit at the time the payment is made online. Also they took 10 days to withdrawl it out of his checking account. He's not happy with them either, not at all.

We finally got our final check from BOA Dec. 18. It'd be great except now we are waiting for BOA to clear it. As if dealing with BOA's stupid 203K dept. wasn't bad enough, BOA's "system" took our December mortgage payment and credited it to our "principle" rather than a payment. So now BOA is calling us and harrassing us as to where our December mortgage payment is. We've called and verified the automatic payment from our checking account was received with a BOA associate. We were told a "gliche" in the system credited our payment to princlpe and they are behind (with everything) on correcting the problem. Get this, you have to call in and request your "payment" be credited to your "payments" on your house and then it takes a few days for them to fill that request.... if they fill any requests at all. That was last week. I just got another call asking where my December mortgage payment is. BOA is a complete fiasco. Will the nightmare ever end? Countrywide was never this bad.

I've heard Bank of America is a pain in the butt to deal with regarding almost any loan once it's an open file and homeowner is in the home. i.e. short sales etc, the agents/realtors working these types of listings mutter cuss words all day about BOA....lol

Good product, bad bank! 203k is a great product to get someone like me who normally probably would have a hard time buying a home in Chicago to be a home buyer, if you are willing to buy a home that needs a little work. However, I would advise anyone to avoid Bank of America like the plague with this product. While other banks are able to disperse funds within a couple of weeks to get the work started, you have to fight Bank of America to get the starting funds within a couple of months and you can't even talk to anyone in the right department without a daily fight.
This is a good loan with the right bank and Bank of America is not that. Unfortunately, I did not know that until it was too late and my loan was already sold to them.

Good luck to all and keep up the good fight. Sharing information like this is the only thing that we have to help each other through "the process". Without this thread I would not have made the progress that I have.

I too am being screwed by BofA on a 203K loan that was sold by my original lender after closing. It has been 60 days since closing and still do not have my first draw. I have called the 866 customer service line and they are useless. Even talked to someone in the dispursement department and they lied to me as well. Case was escalated 4 times and that is useless. Only success I've had was following Ka Vang's advice below and calling Darian Street-Hoover and her number is 336-333-7179. She is the secretary to the CEO/ president of Bank of America. I left her 2 voicemails today and actually received a call back and within 2 hours had a call from the person servicing my loan with updates stating that the money will go out tomorrow and I should have it Monday. Not soon enough but it is something. Still have to see if this happens this time.

Start at the top I guess. Darian is a very nice woman and must have the pull to atleast make things happen. Before this I couldn't even get a phone number to talk to someone in the department that could actually help me. Give it a try.

I finally resorted to calling the HUD office in Denver and was given a # to call for help. Try calling 1-800-225-5342 - Option 1 - A human will answer and LISTEN (even better!) and if warranted, escalate the info to a higher level for action. The promise is to call back within 24 hours with some sort of an answer. I will let you all know what happens from here- hopefully there is somebody at HUD who cares and will help with these messes! HAVE YOUR FHA CASE # WHEN YOU CALL - THEY CAN'T HELP WITHOUT IT. (It will be in your closing documents.) If enough of us call HUD with these horrifying problems with Bank of America, maybe something can be done.

Rachelrn76: Call 1-866-921-4764, someone will answer. Have you signed a "Letter of Completion"? BOA won't order the inspection until they have this paper. Ask the associate either for the "Letter of Completion" to be faxed or mailed to you & ask for the number and address to fax and mail the letter back. Keep a copy. BOA lost our first two Letters of Completion when we sent them. The worst is not over once the inspection is done. Our inspection report was also "lost" when our inspector first sent it, so he had to send it again. Next comes the "title update" which for us took almost 4 weeks!!! (though Sharon Legg said she was putting a "rush" on our title update- a lot of good it did.) We started the process to get our final check Sept. 19, and here it is almost Christmas and we still do not have the check. Although, we have a tracking number now and we are suppose to have the check in hand by Friday. We'll see.

Call the FHA/HUD office for your state and find out what information they need for you to file a compaint to FHA/HUD. Then send a complaint to the email addresses below (on other posts) WITH a forwarded copy of your complaint to HUD. That was the only way we got a response from any of the email addresses to the "superiors" listed below.

Like you, we have no intention of recommending BOA to anyone!

We bought and settled our home in mid Sept with a small bank in MD. We have a 203K loan, and got half of the money at settlement. We were supposed to have access to the rest of the money as our contractor worked on and completed the project. Little did we know that BOA bought our loan, and the money disappeared. We cannot get ahold of anyone and no one answers our calls. We submitted by fax all receipts and invoices on Oct 1. My contractor is devated by non-payment and we have done all that we can do. I have never in my life seen or been involved in such a horrible and frustrating situation.

They said in an email that we are at the "inspection stage" and that an inspector will come out before any money is disbursed, and then nothing since. It has been weeks.

It should be against the law for a bank to hold money that I am paying a mortgage on, and not even send me any account information, or a statement or anything. Bank of America should be ashamed of themselves. I am going to call all the numbers that are posted on this site and see if I can get anywhere...

DO NOT DO BUSINESS WITH BOA! And be sure you ask your lender if your loan will be sold...

Well the "someone" tried to call today while I was driving my son to kindergarten. On my answering machine I left a number to my husband's work so the "someone" could call him there if they didn't get an answer at home. Cynthia (the "someone" who called) left a message on my answering machine that she couldn't get voicemail when she called my husband's work. What you can't wait for the secretary to get him on the phone?!? Seriously, HUMANS answer the phone there.There are no transferring to full message boxes or messages that say "we're experiencing high call volume. Call back later," like you get when you call BOA. Cynthia left a number to call her and guess what? The voicemail is full, like everything else at BOA, useless!! Ughhhhh!

Don't worry, once you get your loan closed, it will not get better. My loan was sold to Counrywide which was immediatly bought out by BoA. I had set up for the bi-monthly payment with an extra $40 out of the principal, and for the last 2 months that the account has been under BoA's website, I keep getting hit with "late" payments because their system will not auto-pay like it is supposed to. They keep telling me that it will be fine, but every month I have to call to have the late payment removed and the payment taken care of. I am giving it one more month and then I am going to be writing some letters. I can't believe this company was bailed out. From what I see, this was a natural course for a company that was ran poorly.

For all of you trying to get your disbursements, contact the Better Business Bureau online. This is the only way that I could get a payment from them. I tried for 3 months calling, faxing letters to the department, but nothing worked until I contaced the BBB.

Good luck with BoA. If you can get a loan elsewhere, I would. Their customer service is worse than any other customer service department I have dealt with.

The "escalating my file" was crap. Today they are claiming something is wrong with my file but can't actually tell me what it is so I can fix it. And they are "escalating" again. I am supposed to call back next Wednesday. Yeah right. So they can tell me to call back again. Monday. What a goat rodeo. I am so ticked. This is beyond ridiculous. Off to file my complaint letters....

So much for tracking numbers. I finaly got a live person and was given 2 different numbers. Both numbers show that BofA only initiated the pick up. The first on was to go out on the 2nd and the last one the 4th. Still nothing when I do get a live person each of them tell me something different. My congressman office has had no luck either getting information.

Well, the number to Darian Street-Hoover resulted in a voicemail with no announcement. We emailed complaints to Jeff Firth-smith, Matthew Lee Warlow, Michael Keating, AND Rebecca Monroe. Absolutely NO RESPONSES! Every phone call to BOA results in another week wait for our disbursement. Even the managers are worthless. They tell us "we're doing everything we can to help you," but in fact they do nothing. Earlier this week we called and spoke to "Brittany" who said we could escalate our file, which would take 3 days. We called back 3 days later to be told it "really takes 7 days." I'm sure if we call "next" week, it will be another 7 days, and after that another 7 days..... Today we contacted the Idaho HUD office. The associate said he would look into our complaint. He also said, "This is not the first complaint we've had about Bank of America for the 203K loans." We filed a formal complaint with HUD and with the BBB and forwarded copies of our HUD & BBB complaints to BOA at 4:17 PM. At 5:39PM Rebecca Monroe responded saying "someone" from servicing will contact us tomorrow. Well, we'll see....... If you want BOA to do anything at all, contact HUD in your area and file a complaint. Maybe that is the only thing BOA will respond to.

I HAVE THE ANSWER. I got my final disbursement check in 2 days through FedEx PRIORITY mail.

Like all of you, I've been dealing with this crap for 3 months. Calling, emailing, no response... calling, emailing, no response. It got to the point where my contractor threatened to put a lien on my house and sue me. I was tired of being the helpless middle person so on Thursday, 12/3/09, I called all the numbers listed below in one of the answers. Not surprisingly, only ONE person answered their phone. She said she was unable to help me so she directed me to the CEO/PRESIDENT'S office and guess what??? Another LIVE person actually picked up... you mean, people are actually working and picking up their phones??? Amazing! Anyway, I told her my story and all the similar stories on internet forums and she said she'll take action right away and file an "executive complaint" against the 203k Department. That evening, I received a call from the 203k department that my check was on its way with a TRACKING NUMBER. On Saturday, 12/5/09, I received my final disbursement check and my contractors are finally off my case.

The sweet woman in the CEO/President's office is Darian Street-Hoover and her number is 336-333-7179. I just called to thank her right before posting this answer to prove that her direct number works. Call her and she'll make sure you get your money.

I have sent a email to my Congressman and to Senator John Mcain, who is our Senator for Arizona. I then sent an email to all the supervisors listed below and copied Sharon Legg. We'll see if I get any response tomorrow. In the afternoon I will be talking to our channel 3 news anchor (his kids go to school with mine) who does the Investigative reports. I'll see what he has to say. Everyday is worse and worse. We cant even get health care because we cant pay the premium! I am so frustrated with gettting the run around with this bank!

I haven't sent my HUD complaint yet, though I will. Last week I emailed a draft of it to the SVPs that Southern Belle listed and said I was sending it unless they dealt with my disbursement issue. Three hours later I got a call from Karrie Riggans. Coincidence? I think not. Of course, I still don't have that check. Every day, my contractor beseeches me to pay him. Today I called Barbara DeSoer's office per Southern Belle and spoke to someone there. Now, supposedly, she's working on this too. But nothing ever gets resolved.

Here are the directions for filing a complaint:

If you have a complaint against an FHA approved lender, you should submit your complaint in writing to the appropriate FHA Homeownership Center (HOC) that is responsible for the State where the home you were buying is located. You can find the HOC responsible for each State by going to the following HUD website: http://www.hud.gov/offices/hsg/sfh/hoc/hsghocs.cfm
Address your letter to the Director, Quality Assurance Division at the appropriate HOC.

We need to flood them with letters!

One more thing: I called the "new" 866-921-4764 number yesterday and told the rep who answered that my HUD inspector had sent in a third draw to 203k.disbursement.unit@bankofamerica.com and could she pull it up. She had never even HEARD of this e-mail address, much less did she have access to it. That new number seems basically useless.

Who has Karrie Riggans' number? She called me last night to say that they were (finally!) processing my contractors first check but that his W-9 was kicked back for some reason. Now I need to get back in touch with her but only have her extension.

FYI: Last week I drafted a letter to the regional HUD Homeownership Office lodging a lender complaint RE BoA. Before I sent it, I copied all the SVPs you guys listed below. Three hours later I got a call and they are finally working on my check and have credited my December mortgage payment the way they were supposed to. Truly sad that it took such extreme measures. But I'm STILL waiting for that check.

We've been fighting with BOA since Sept. 19th to get out final 203K Streamline disbursement. Evan Gary was handling our case & as soon as we sent our letter of completion he skipped town on a 2 week vacation! Then he can back & ordered our title and went on a leave of absence without passing our file on to someone to take care of it. After a MONTH of leaving messages and calling BOA worthless #'s we talked to Sharon Lang who set for our title update. November 17 we got an email from Sharice Nash saying the final funds would be disbursed in 5-7 days. Called Sharon Lang, Vince, and old 203K line many times leaving many messages. No one calls back. Maybe they think if they don't they can keep the loan money. Today is Dec. 7 and still no check in sight. Called BOA's "new" 203K phone line and was told to call back in 3 days (again) to see if they have put a rush on the check. Just got an email tonight from BOA saying they never received the letter of completion, which we mailed to them September 19th and were told by Evan Gary that it was in. NOW BOA is saying we have to send the letter of completion before the funds can be disbursed. WHAT? Evan Gary told us the title update couldn't be ordered until BOA received the letter of completion. Nov 17 Sharon Lang said the title update was done. Now they are telling us nothing has been done? I have $17,000 in contractor bills to pay for the required repairs for our house and a lein on my house. Who knows the damage BOA has done to my once perfect credit now? Seriously, does any one else out there want to sue?!?

The flood gates have opened. I don't understand how they can charge interest on something that has yet to be attained (monies). I just can't believe that they have gone so long without being regualted. Look how many people have this happened too and all the ones that are not on here. Shame on them.

I need some help with my BofA 203 streamline k loan. You're all 1 step ahead of where I am so hopefully someone can answer, since after being on hold for an hour with BofA we're getting no where. Here's the situation:

We closed with our broker at the beginning of October, shortly after the mortgage was sold to BofA. We billed in 5,000 dollars for a new washer/dryer and kitchen appliances. We just bought our washer dryer pair 2 weeks ago, and now we can't find out what paperwork to fill out and who to send it to to collect our first draw. How do you start the draw process in the first place? What paperwork do we fill out, who do we send it to, and what should we expect? Thanks guys!

For the record, I tried calling the"new" number (866-921-47620- The recording says to call back during regular business hours- it is 1:29 in the afternoon...... As with all things involving B of A and the 203K loan,there is nobody home. I submitted my receipts for the final draw on October 25, compliance inspection was done then, too- no response to repeated emails, can't leave message anywhere- not that it would be answered- and my contractors are threatening to lien. They have been more than patient and work is slow everywhere- they need their money! B of A won't dispurse funds if there is a lien on the property- and if contractors can't get paid guess what they do! I am paying monthly - including interest - on money I can't access and these guys aren't accountable. There must be something we can do.........

I had called the (866) 921-4764 number and spoke with Lynell in Plano, Texas who let me know that NONE of the departments at B of A are communicating with each other, and that they have to answer the phones because the Orginal department that was handling the case, is too busy to talk to me right now. This has been going on since August. I am so extremely frustrated with this whole thing! How am I suppose to run a business when I dont have the capital to do so? We paid all of our subs in full, up front, so now we are waiting for our profit so we can pay OUR bills!!! I have called every number and left messages for Vince, Sharon and Barbara! Still to no avail! I will speak Gary Harper on Wednesday, who does the Investigative Report for Channel 3, 3 On Your Side. Maybe he can do a report on this and see who dropped the ball. Maybe he can find out why B Of A is having such a difficult time handling these loans and getting payments out to people. If there is a class action lawsuit, please count us in.

I did a job in colorado springs and its been 2 months since we submitted the invoice and we havent had no responce from: Tammy K. Lopez, Carol A. Sherman or anybody in charge.
The economy is bad enough, and now this!!!
People need to know this we need to make sure that they dont get away with it, have any ideas?

I called 1-866-921-4764 and got a human! I am also suspicious but at least hopeful. While on the phone my cell rang and it was BOA. Someone returned my call from my message last week and left a voice mail. Maybe things are looking up. Here is another number to try 1-800-293-8155.

I believe they have just assigned customer service staff to take messages for the 203k rehab department. Hopefully that frees them up to chug through those loan papers and get caught up.
