Tom is right, it is a man made waterfall operated by a pump.
I took a look at this property last Sunday while they were having an open house. This subdivsion is located next to the creek and homeowners are currently required to carry flood insurance. There have been several homes in this area that have successfully appealed this flood insurance requirement. I was told by the listing agent that this home stayed dry when this creek spilled over and the current homeowner was going to file an appeal as well .
The house itself appears to be in good shape but needing cosmetics to bring it up to par.

Hope this was helpful.

It looks like the water fall is man made so they are probably using a pump.
